Drafting the Notice and Motion to Avoid Lien under 11 U.S.C. §522(f) for Real and Personal Property  This discussion will focus on drafting both the Notice of Motion and Motion to Avoid a Lien pursuant to 11 U.S.C. §522(f). More specifically, it will address how to avoid a judicial lien on real property (e.g. recorded judgment from prior collections suit) or personal property (e.g. garnished/levied monies) that impairs a Debtor’s exemption. Time permitting; it will also address how to properly record the order granting relief with respect to real property.

Presented by: Harlene Miller, Esq.  Ms. Miller has practiced law since 1990, specializing solely in bankruptcy and insolvency.   Ms. Miller is a Certified Specialist in Bankruptcy Law, The California Board of Legal Specialization, representing Debtors and Creditors  (both individuals and business entities) in Chapter 7, 11 and 13 cases, handling bankruptcy litigation, and offering non-bankruptcy assistance with financial workouts.  After 25 years as a shareholder and managing attorney for Pagter and Miller, Ms. Miller is opening her own firm commencing July 1, 2014 in Irvine.  As “Harlene Miller Law,” Ms. Miller will continue providing legal services related to bankruptcy and insolvency, with personal care and attention to her clients.

OCPA is a State Bar of California Approved MCLE provider and certifies that this seminar qualifies for MCLE CREDIT 1.0.

Event Fee: $10.00 for OCPA members, $20.00 for non-members and $20.00 for all walk-ins who have not pre-registered online.   

Parking is free for individuals that leave after 7:00 pm when the attendant has left for the day. Parking fees are not covered by OCPA or Sonoma Court Reporters.
