The Basics of Consent Law This presentation will walk through the health care fundamental concept of consent law. This includes when consent for a medical procedure is needed, who can give consent, and what form consent should be provided in. We will discuss the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the Health Information Technology for Economic and Clinical Health Rule (HITECH), and the protections these rules provide for patient health information. We will also discuss issues which apply generally in the legal field such as advance health care directives and subpoenas for medical information. There will be some emphasis on the varying laws that apply particularly to minors and the elderly.
This presentation is helpful to anyone who is looking for a general overview or refresher of consent concepts. Any practitioners who request patient information will find this information useful in navigating the laws and rules that govern the hospital’s ability to release such information.
Presented By: Sheniece Smith, Associate Counsel for Children’s Hospital of Orange County (CHOC) Sheniece started with CHOC in 2008 and worked her way up as she worked her way through law school. Sheniece earned her paralegal certificate from the University of California, Irvine in 2008 and graduated cum laude from the University of La Verne College of Law in 2012.Sheniece is also the owner of H.O.P.E. Through Affordable Legal Services which aims to bridge the gap between legal aid and full attorney fees for those who would not otherwise have representation.
