Ethical Issues that Arise in Preservation and Collection

Presented by: Trent Walton, Chief Technology Officer for U.S. Legal Support

www.uslegalsupport.com

Explore the ethical dilemmas constantly facing attorneys when they try to counsel clients on the proper preservation of discoverable evidence. The introduction of electronic data has made it increasingly complex to identify and produce relevant evidence to requesting parties. Learn best practices to deal with this new threat along with proper application using realistic hypotheticals.

Topics that will be covered:

- How to better instruct the client when there is a “duty to preserve.”

- How to ensure that you are disclosing and receiving all reasonably relevant discovery.

- Best practices for clients to be more proactive at the start of a litigation.

- How to manage a client that refuses to follow attorney instructions.

- Techniques to limit costs and liability.
